A legal disclaimer

 

We are committed to protecting the privacy of the personal data (“Personal Data)” we hold and complying with the requirements under the Hong Kong SAR Personal Data (Privacy) Ordinance Cap.486

This policy sets out the basis on which Legal Friendly together with its subsidiaries (collectively, “we” “our” or “us”) collects, use, store and handle personal data from time to time. 

This Privacy Policy agreement was created using a template from Legal Friendly. You must retain the credit owned by Legal Friendly. Using this agreement or its content without the credit is an infringement of copyright. However, you can purchase an equivalent agreement from us that does not include the credit or engage our contractual amendment services to tailor your Privacy Policy agreement.

By visiting our website legalfriendly.com (our “Site”) you accept and consent to the practices set out below. 

1       Information Collection

1.1      We may collect and process the following information about you:

(a)    Information you give us – information that you provide us (which may include your name, email address, contact number, address and/or district, credit card information, and other personal descriptions or questionnaire answers) when you register with us, use our services, or communicate with us (by phone, email or otherwise), for example:

(i)      when you report any problem to us;

(ii)     when you use certain features on our Site;

(iii)    when you request any support from us; or

(iv)   when you complete any survey or questionnaire.

(b)    Information we collect about you – information automatically collected when you visit our Site, for example:

(i)      technical information, including the Internet protocol (IP), your log-in and password details, browser type and version, language, access times, browser plug-in types and versions, operating system and platform;

(ii)     information about your visit, including the full Uniform Resource Locators (URLs), clickstream to, through and from our site (including date and time), pages you visit on this Site or searched for, the referring page that linked you to us (e.g. another website or search engine), the pages you visit after this Site, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone number used to call our customer service number; and

(c)    Information we receive from third parties – We work with third parties and we may receive information about you from them, for example, business partners, freelancers, contractors, payment and delivery services, advertising networks, analytics providers, search information providers, or other agencies. We will notify you when we receive information about you from them and the purposes for which we intend to use that information.

1.2      Certain personal data or information are required for the purpose of enabling you to receive or to provide the specific services from freelancers and to consumers. The provision of such personal data or information is voluntary, however, failure to provide such data as requested may result in us being unable to provide the requested service offers and requests, perform our functions or deliver our services to you.

1.3      We only retain personal data for so long as it is necessary for the fulfilment of the purpose for which the data is or is to be used. Data may be archived as long as the purpose for which the data was used still exists.

2       Use of information 

2.1      We use information held about you for the following purposes:

(a)    providing, improving and developing our services, and to provide information to you and to third parties to enable you to obtain the requested service or make service offers;

(b)    identification and verification purposes in connection with any of the service that may be supplied to you and the registration of a user account with us;

(c)    presenting content and information in our Site in the most effective manner for you and for the device you use;

(d)    payment purposes for our service, including verification of credit card details with third parties;

(e)    with your consent, for marketing or promoting any of our services (e.g. sending you updates on our latest offers and promotions in relation to any of our services from time to time, which you may opt out at any time by contacting our customer service);

(f)     communicating with you and responding to your questions, requests, complaints, enquiries or feedback;

(g)     responding to or taking part in legal proceedings, including but not limited to obtaining legal advice, and exercising, defending and/or protecting our rights or properties, and collecting overdue amounts;

(h)    improving the functionality of the Site; and

(h)    purposes directly related or incidental to the above.

3       Disclosure of information

We will keep your personal data we hold confidential but you agree we may provide information to:

(a)    any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries.

(b)    personnel, agents, advisers, auditors, contractors, financial institutions, consumers and service providers in connection with our operations or services (for example freelance engaged in the fulfilment of your service request, the processing of your payment and the provision of support services);

(c)    our overseas offices, affiliates, business partners and counterparts (on a need-to-know basis only);

(d)    persons under a duty of confidentiality to us;

(e)    persons to whom we are required to make disclosure under applicable laws and regulations in any part of the world; or

(f)     a third party that acquires all or part of our assets or shares, or that succeeds us in carrying on all or a part of our business, whether by merger, acquisition, reorganization or otherwise.

4       Cookies

4.1      Our Site uses cookies to distinguish you from other users of the Site and to find out more about the use of our Site and user preferences. This helps us to provide you with a good experience when you browse our Site and also allows us to improve our Site.

4.2      Most web browsers are initially set up to accept cookies. You can choose to ‘not accept’ cookies by changing the settings. However, if you do so, you may not be able to access all or parts of our Site.

4.3      We use persistent cookies and session cookies. Session cookies are only used during a session online and will be deleted once you leave a website. Persistent cookies have a longer life and will be retained by the website and used each time you visit a website. Both session and persistent cookies can be deleted by you at anytime through your browser settings and in any event, will not be kept longer than necessary.

4.4      We may use third-party web services on our Site. The service providers that administer these services use technologies such as cookies (which are likely to be analytical/performance cookies or targeting cookies), web server logs and web beacons to help us analyse how visitors use our Site and make the information displayed on it more relevant to your interests. The information collected through these means (including IP addresses) is disclosed to these service providers. These analytics services may use the data collected to contextualise and personalise the marketing materials of their own advertising network.

5       Third-party sites

Our Site or our communication with you may from time to time contain links to third-party websites over which we have no control. If you follow a link to any of these websites, please note that they have their own practices and policies. We encourage you to read the privacy policies or statements of these websites understand your rights. We accept no responsibility or liability for any practices of third-party websites.

6       Security 

6.1      All information you provide to us is stored on our secure servers. Please note, however, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Site; any transmission is at your own risk. We shall not accept any liability unless negligence on our part is proved.

6.2      Where we have given you (or where you have chosen) a password that enables you to access certain parts of the Site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

6.3      We restrict access to personal information to our employees, service providers and contractors on a strictly need-to-know basis and ensure that those persons are subject to contractual confidentiality obligations.

7       Data transfer

         We will generally hold your data on our servers hosted in Hong Kong. However, the data that we collect from you may be transferred to, and stored at, a destination outside Hong Kong. It may also be processed by persons listed in Clause 3 above who operate outside Hong Kong. Where such a transfer is performed, it will be done in compliance with the prevailing requirements of the ordinance.

8       Your rights

8.1      You have the right to:

(a)    check whether we hold personal data about you;

(b)    access any personal data we hold about you; and

(c)    require us to correct any inaccuracy or error in any personal data we hold about you.

8.2      Any request under Clause 8.1 may be subject to a small administrative fee to meet our cost in processing your request.

9       Changes to our privacy policy

We may amend this policy from time to time by posting the updated policy on our Site. By continuing to use our Site and our App after the changes come into effect means that you agree to be bound by the revised policy.
